Gas safety certificates, formally known as Gas Safety Records, are a legal requirement that causes confusion because the obligation is widely discussed in the context of property but applies specifically to landlords rather than to all homeowners. Understanding who is required to have one, and why owner-occupiers are treated differently from landlords, clarifies the position for most homeowners.

The Legal Obligation

Under the Gas Safety (Installation and Use) Regulations 1998, landlords who let residential properties must arrange an annual gas safety check by a Gas Safe registered engineer on all gas appliances and flues in the property, and must provide tenants with a copy of the resulting Gas Safety Record within 28 days of the check. This obligation applies to landlords of all types of rented accommodation, including houses, flats, bedsits, and holiday lets.

The obligation does not extend to owner-occupiers. A homeowner living in their own property has no legal requirement to have a gas safety check carried out or to hold a Gas Safety Record. This is true regardless of how old the appliances are or how long it has been since a service was carried out.

Why Homeowners Should Still Service Their Appliances

The absence of a legal requirement does not mean that gas appliance servicing is unimportant for homeowners. On the contrary, regular annual servicing of gas boilers, fires, and cookers by a Gas Safe registered engineer is strongly recommended for safety, efficiency, and appliance longevity. Carbon monoxide, the silent killer produced by malfunctioning gas appliances, is as dangerous in an owner-occupied home as in a rented one.

Most boiler manufacturers also require annual servicing to maintain the warranty on the appliance. A boiler that has not been serviced within the warranty period may have warranty claims declined by the manufacturer if a fault develops. Regular servicing also ensures the appliance operates at maximum efficiency, reducing energy consumption and running costs.

When Selling a Property

When selling an owner-occupied home, a buyer's solicitor may ask about gas safety records and servicing history for the appliances. While there is no legal obligation to provide a Gas Safety Record, evidence of regular servicing can reassure buyers and their mortgage lenders that the appliances are in good condition. A home buyer's survey may flag appliances that appear to be old or unserviced as a risk item requiring further investigation.

Becoming a Landlord

If you are an owner-occupier who is considering letting your property, whether as a traditional tenancy or through short-term rental platforms, you become subject to the landlord gas safety obligations the moment you let the property to a tenant. This means arranging a Gas Safety check before or at the start of the tenancy and annually thereafter, and providing the Gas Safety Record to the tenant. Failing to do so as a landlord is a criminal offence.
