Do You Need Planning Permission for a Garden Room?
Most garden rooms fall within permitted development and do not require planning permission. The key conditions relate to size, height, position, and whether the property is in a designated area.Garden rooms have become one of the most popular home improvement projects in recent years, particularly for use as home offices, studios, gyms, and hobby spaces. For most properties in England, a garden room falls within the permitted development rights for outbuildings and does not require a planning application, but specific conditions must be met.
Permitted Development Rules for Garden Rooms
A garden room is treated as an outbuilding for planning purposes and is governed by Class E of Part 1 of the General Permitted Development Order. The permitted development conditions allow a garden room to be built without planning permission if it is located within the curtilage of a dwellinghouse, is not forward of the principal elevation of the house or to the side of the house facing a highway, does not exceed 2.5 metres in eaves height, does not exceed four metres in height with a dual-pitched roof or three metres with any other roof type, does not cover, together with all other outbuildings and extensions, more than 50 percent of the curtilage excluding the original house footprint, and is not used as a separate dwelling.
When Planning Permission Is Required
Planning permission is required for a garden room that exceeds the height limits, that is positioned forward of the principal elevation of the house, that takes the total outbuilding and extension coverage above 50 percent of the curtilage, that is at a listed building, or that is in a conservation area where additional restrictions apply to outbuildings visible from a highway. Flats and maisonettes do not benefit from the residential outbuilding permitted development rights.
Designated Areas
In National Parks, Areas of Outstanding Natural Beauty, and other designated areas, the permitted development rules for outbuildings are more restrictive. Any outbuilding over 15 square metres that is more than 20 metres from the dwelling, or any outbuilding between the dwelling and a highway, may require planning permission in these areas even if it would be permitted development elsewhere.
Use as a Dwelling
A garden room that is equipped and used as a self-contained residential dwelling, with sleeping accommodation, a kitchen, and bathroom, goes beyond the outbuilding permitted development rights. Change of use to a dwelling requires planning permission regardless of the size of the structure. This applies even if the garden room is within the permitted development size limits; the use as a dwelling is what triggers the planning requirement.
For formal confirmation that a proposed garden room is lawful under permitted development, a Lawful Development Certificate can be applied for from the local planning authority. This is not required but provides a written confirmation that is useful when selling the property and removes any future uncertainty about the planning status of the structure.
Building Regulations
Garden rooms up to 15 square metres are generally exempt from Building Regulations as detached outbuildings. Between 15 and 30 square metres, exemption applies if the structure is more than one metre from the boundary or is of non-combustible construction. Above 30 square metres, Building Regulations approval is required. Any garden room with electrical installations must comply with Part P, either through a registered electrician or through Building Control notification.
